Regolamento Noleggio Bike
- Per ottenere il noleggio di una bicicletta a pedalata assistita l’utente deve presentare preventivamente alla società GIOVANNELLI CICLI un documento di identità valido, una carta di credito non ricaricabile: tali documenti verranno trattenuti dal gestore fino al termine del noleggio. In alternativa al deposito della carta di credito è possibile versare una cauzione di 250 € in contanti.
- L’uso della bicicletta presuppone l’idoneità fisica e la perizia tecnica di chi intende condurla. Pertanto L’utente noleggiando la bicicletta dichiara di essere dotato di adeguata capacità e di appropriata competenza senza porre alcuna riserva. Nel caso di utilizzo da parte di minori con la sottoscrizione del presente contratto il genitore affidatario oppure tutore del minore si assume tutte le responsabilità indicate nel presente contratto e dal codice civile, conseguentemente autorizza il minore all’utilizzo della bicicletta alle condizioni previste dal presente regolamento.
- La bicicletta è da utilizzarsi esclusivamente come mezzo di trasporto e da trattarsi con attenzione, buonsenso e diligenza, in modo da evitare danni sia alla stessa che ai relativi accessori. E’ vietato l’utilizzo della bicicletta per svolgere attività commerciali ne è possibile cederla in uso ad altri soggetti.
- L’utente è responsabile della bicicletta elettrica fino alla sua restituzione al gestore, e inoltre responsabile dei danni causati a se stesso, alla bicicletta, a terzi e a cose durante l’uso del mezzo. Al gestore non potrà essere richiesta nessuna forma di indennizzo.
- Durante il noleggio l’utente non gode di nessuna forma assicurativa nè la bicicletta elettrica è coperta da assicurazione RC. L’utente è pertanto tenuto a rispettare le norme del codice della strada. Il gestore declina ogni forma di responsabilità in caso di utilizzo improprio del mezzo o di mancato rispetto delle norme del codice della strada.
- Il gestore può effettuare controlli agli utenti durante l’uso delle biciclette e può richiederne la restituzione se ravvisa le condizioni di un utilizzo improprio del veicolo. Il gestore potrà rifiutare il noleggio a persone in stato di ubriachezza o sotto effetto di sostanze stupefacenti (a norma degli art. 186/187 del codice della strada) e per altri motivi a insindacabili giudizio del gestore stesso.
- In caso di smarrimento delle chiavi, degli accessori della bicicletta o per danni il gestore richiederà al cliente la somma necessaria per il ripristino originale della bicicletta, sulla base di quanto indicato nel presente contratto o, in mancanza del listino, e del preventivo del fornitore, in caso di furto totale l’utente dovrà risarcire il gestore dell’importo stabilito in € 1.000,00 per ogni bicicletta in carbonio e € 200,00 per ogni bicicletta in alluminio.
- La bicicletta dovrà essere riconsegnata, nel rispetto degli orari indicati nel presente contratto, nello stesso luogo in cui è stata noleggiata. La bicicletta è considerata riconsegnata solo se restituita direttamente al gestore con la controfirma della riconsegna del contratto; non può essere considerata consegna il parcheggio della bicicletta elettrica al di fuori del punto di noleggio durante l’orario di chiusura. La mancata restituzione della bicicletta senza preventiva comunicazione o comunque non motivata da casi eccezionali, sarà considerata alla stregua di un reato di furto e pertanto denunciato alle autorità giudiziarie.
- L’utente dovrà corrispondere il relativo pagamento dal momento dell’inizio del noleggio fino a quando non si presenterà per la chiusura del contratto di noleggio, oltre a eventuali addebiti per danni, furti totali o parziali.
- In caso di furto della bicicletta elettrica, l’utente dovrà presentare al gestore copia della denuncia effettuata presso gli organi competenti e versare l’importo pari al valore della bicicletta oggetto del furto (vd art. 7) che gli verrà restituito in caso di ritrovamento o recupero del veicolo stesso.
Bike Rental Regulations
- To obtain the rental of a pedal assisted bicycle the user must present in advance to the company GIOVANNELLI CICLI valid identity document, a non-rechargeable credit card: these documents will be held by the manager until the end of the rental . As an alternative to a credit card deposit, a deposit of € 250 can be paid in cash.
- The use of the bicycle presupposes the physical fitness and the technical expertise of those who intend to lead it. Therefore the user by renting the bicycle declares to be equipped with adequate capacity and appropriate competence without placing any reserve. In the case of use by minors with the signing of this contract, the custodial parent or guardian of the minor assumes all the responsibilities indicated in this contract and the civil code, consequently authorizing the child to use the bicycle under the conditions provided for by this regulation .
- The bicycle is to be used exclusively as a means of transport and to be treated with care, common sense and diligence, in order to avoid damage both to itself and to its accessories. It is forbidden to use the bicycle to carry out commercial activities and it is possible to transfer it to other subjects.
- The user is responsible for the electric bicycle until it is returned to the operator, and also responsible for damage caused to himself, the bicycle, third parties and things during use of the vehicle. No form of compensation can be requested from the manager.
- During the rental the user does not enjoy any form of insurance nor the electric bicycle is covered by RC insurance. The user is therefore required to comply with the rules of the highway code. The manager declines all responsibility in case of improper use of the vehicle or failure to comply with the rules of the highway code.
- The operator can carry out checks on the users during the use of bicycles and can request a return if he finds the conditions of improper use of the vehicle. The manager may refuse the rental to persons in a state of inebriation or under the influence of drugs (in accordance with Article 186/187 of the Highway Code) and for other reasons at the sole discretion of the manager himself.
- In case of loss of keys, bicycle accessories or damage, the operator will ask the customer for the sum necessary for the original restoration of the bicycle, on the basis of what is stated in this contract or, in the absence of the price list, and the supplier's estimate, in case of total theft, the user will have to compensate the manager for the amount set at € 1,000.00 for each carbon bicycle and € 200.00 for each aluminum bicycle.
- The bicycle must be returned, respecting the times indicated in this contract, in the same place where it was chartered. The bicycle is considered to be returned only if returned directly to the manager with the counter-signature of the redelivery of the contract; parking of the electric bicycle outside the rental point during closing time can not be considered. Failure to return the bike without prior notice or in any case not motivated by exceptional cases will be considered as a crime of theft and therefore reported to the judicial authorities.
- The user must pay the corresponding payment from the start of the rental until it shows up for the closing of the rental contract, in addition to any charges for damages, total or partial theft.
- In case of theft of the electric bicycle, the user must present to the manager a copy of the report made to the competent bodies and pay the amount equal to the value of the bicycle object of the theft (see item 7) that will be returned in case of finding or recovery of the vehicle itself.
